What are the conditions for foreigners to work in China?

It is necessary to obtain a work residence permit, otherwise holding a work visa to work will be considered illegal work. Mild punishment may include having a bad record, and severe punishment may include direct deportation and a deadline for entry.

Firstly, foreigners applying for a Chinese work visa need to meet certain application conditions. These conditions include:

1. The applicant should be at least 18 years old, in good health, have no criminal record, and possess the necessary professional skills or appropriate knowledge level to engage in their work.

2. The work undertaken by the applicant should meet the needs of China’s economic and social development, especially for professionals who are urgently needed and in short supply domestically.

3. The applicant needs to have a confirmed employer within the country, which must be established in accordance with the law, have no serious record of illegal or dishonest activities, and the position for hiring foreigners should have special needs, suitable candidates are temporarily lacking domestically, and the position does not violate relevant national regulations. At the same time, the employer shall pay the wages and salaries of the employed foreigners not lower than the local minimum wage standard.

After meeting the above conditions, foreigners need to apply for work permits and residence permits according to the following steps:

1. Sign a service agreement and pay the service fee, assist in registering and applying for an account online.

2. Conduct online pre examination, apply for the “Notice of Foreigner’s Work Permit for China” and conduct document review.

3. After obtaining the principle approval notice, the license notification information will be exchanged with the Ministry of Foreign Affairs.

4. After obtaining formal approval, the visa will be issued. The applicant enters China after obtaining a visa.

5. Within 15 days after entry, it is necessary to apply for a work permit online and submit paper materials.

6. After the review materials are approved, notify the on-site collection of the “Foreigner’s Work Permit for China”.

7. Exchange permit information to the public security department, provide feedback on residence and other information, and apply for work or residence permits.
