The cancellation of work permits for foreigners who leave their jobs is mainly divided into two parts: the cancellation of work permits and the cancellation of residence permits. The details are as follows:
1. Work permit cancellation:
-Preparation materials:
-The Application Form for Cancellation of Foreigner’s Work Permit in China shall be affixed with the official seal of the employer.
-Proof materials related to the termination of employment relationship, contract termination, or other reasons for cancellation must be signed by both parties. For example, resignation certificate, termination of labor contract agreement, etc.
-Online application: employers log in to the “Foreigner Work Management Service System”, fill in relevant information, upload application materials, and conduct online preliminary review.
-On site processing: After the pre-approval, the employer shall submit the original and photocopy of the relevant materials to the accepting institution for verification. After the acceptance institution approves the review, the employer can obtain a work permit cancellation certificate.
2. Cancellation of Residence Permit:
-Preparation materials: After obtaining the work permit cancellation certificate, the applicant needs to prepare the original temporary accommodation registration form, passport, photo, resignation certificate and other materials.
-Go to apply: The applicant should go to the immigration department to handle the cancellation procedures of the residence permit.
Generally speaking, the employer should apply for cancellation of the work permit within 10 working days from the date of the foreigner’s resignation. If the cancellation procedures are not handled in accordance with regulations, foreign workers and employers may be held legally responsible.
