In order to reduce the time for foreign talents to apply for the certificate of no criminal record of foreigners for too long, which will affect their entry time, some regions implement the filing system of no criminal certificate for qualified foreign talents, which not only eliminates the need to provide the certificate of no criminal record, but also greatly improves the time for obtaining work visas. So, which foreign nationals can be exempted from criminal recruitment?
1. Young foreign talents such as foreign scientific researchers in the scientific research team and recent doctoral graduates in key disciplines such as science, industry, agriculture and medicine are directly included in the scope of application of the Confirmation Letter for Foreign High end Talents. They are allowed to directly apply for foreign talent visas (R visa), and can enjoy relevant treatment such as material exemption, process simplification, etc.
2. The foreign talent visa (R visa) will be valid for 5 to 10 years, with multiple entries and 180 days of stay each time. The spouse and minor children will also be issued with the same period of validity and multiple entry visas of the same type.
3. If employers need professional scientific and technological talents, they can appropriately relax the requirements for age, education, and work experience, and enjoy green channels. Foreign scientific and technological talents who need to work part-time, innovate and start businesses in Shanghai do not need to reapply or change their work permits after reporting to the Municipal Science and Technology Commission (Municipal Foreign Experts Bureau) by the employing unit.
4. The filing system of proof of no criminal record for foreigners’ visa application is implemented. On the basis of the commitment of no criminal record for foreign high-end talents (Class A), Version 4.0 stipulates that foreign scientific and technological talents employed by the city’s employers can refer to foreign high-end talents (Class A). When handling the permit for foreigners to work in China, the “notification+commitment” system of proof of no criminal record is implemented, that is, foreign talents directly promise “no criminal record” on the application form, without additional proof of no criminal record and certification materials, and the employer can provide proof.
5. The channel for “holding international general vocational qualification certificates or urgently needed skilled talents” in the “Foreign Professional Talents” category has been officially launched, and foreign high skilled talents are divided into three categories for admission: “holding national general foreign vocational qualification certificates”, “urgently needed and scarce skilled talents in this city”, and “holding other international general vocational skills talents”. The age limit has been further relaxed to 70 years old.
