When foreign employees resign, the company needs to cooperate in completing a series of tasks to ensure the legality and completeness of the resignation procedures.
1. Termination of labor contract and settlement of salary
According to company regulations and labor contract agreements, terminate the labor contract and settle the wages of departing foreign employees, including basic salary, overtime pay, bonuses, allowances, etc., to ensure accurate and error free wage settlement.
2. Assist foreign employees in canceling their work and residence permits
Cancellation of work permit: within 10 working days from the date of resignation, apply for cancellation of foreigners’ work permit in China to the decision making agency, fill in the Application Form for Cancellation of Work Permit, and provide the original passport and information page, residence permit page, electronic version of work permit, resignation certificate, tax payment certificate of foreigners in the past 12 months and other materials.
Assisting in the cancellation of residence permits and processing of stay visas: Enterprises are required to provide the application form for stay visas, the application form for cancellation of residence permits, the original and photocopy of the approval certificate for foreign-invested enterprises, invoices for social security contributions made by Chinese employees in the past three months, the original and photocopy of the ID card of the foreign affairs officer, and the original and photocopy of the company’s business license.
3. Provide formal resignation certificates for foreign employees
Enterprises should provide foreign employees with a formal certificate of resignation when they resign. The resignation certificate should clearly indicate the reason for resignation, the date of resignation, and other information, and be stamped with the company seal to prove the termination of the labor relationship between both parties
